Terms of Services

These Terms of Service govern the use of charisdor.com and purchases made directly through the website. The seller is Molder Plastic Products, operating the Charis D’or brand ("Charis D’or", "we", "us", or "our"). Please read these Terms before placing an order and keep a copy for your records.

By affirmatively accepting these Terms at checkout and submitting an order, you agree to the provisions applicable to that transaction. Nothing in these Terms excludes or reduces rights or remedies that cannot lawfully be waived under Philippine law, including applicable consumer protection laws.

Please use these contact details for order inquiries, cancellation requests, product concerns, and complaints. Contact us before sending a return so we can provide the appropriate return or collection instructions. The registered address is not automatically a parcel return address.

2 Eligibility and customer information

You must be at least 18 years old and legally capable of entering into a contract to place an order independently. A parent or legal guardian must place the order for a minor. If you purchase on behalf of another person or business, you must have authority to do so.

Provide accurate contact, delivery, and payment information, and review your order before submitting it. Use only payment methods you are authorized to use. If accounts are offered, protect your login details and promptly report suspected unauthorized access. You are not automatically responsible for transactions resulting from a failure of our own security or obligations.

3 Products and product information

We sell cosmetics and skincare products as described on the relevant product pages. We aim to provide accurate descriptions, ingredient information, quantities, prices, instructions, and warnings. Products supplied must conform to the applicable description, warranties, and legal quality and safety requirements.

Screen settings and lighting may affect how a shade appears online, but this does not excuse a material mismatch with the advertised product. Packaging may be updated without changing the product itself. We will not substitute a different product, shade, size, or materially different formulation without your agreement.

Availability may change. If an item becomes unavailable after you order, we will contact you about an agreed alternative or cancellation and the refund due. Any specific performance guarantee or promotion applies according to its disclosed terms and cannot reduce your statutory rights

4 Orders and acceptance

Submitting an order is an offer to buy the selected products at the total presented at checkout. An automatic message acknowledging receipt of an order is not, by itself, acceptance. We accept an order when we expressly confirm acceptance or dispatch it, whichever happens first, subject to any earlier binding agreement required by law.

Before acceptance, we may decline an order for a reasonable reason, such as unavailable stock, an unsupported delivery address, failed payment authorization, reasonably suspected fraud, or a material listing error. We will explain the issue and promptly return any amount collected for a declined order. An accepted order will not be arbitrarily cancelled or repriced.

If a material price or description error affects your order, we will contact you with the correct information. We will not charge an additional amount without your agreement. Any cancellation of an already binding sale must have a lawful basis or your agreement, with the applicable refund and other rights preserved.

5 Prices and payment

Prices are stated in Philippine pesos (PHP) unless expressly indicated otherwise. Applicable taxes and any delivery or other charges will be clearly disclosed before you confirm your purchase. The payable total is the amount you agree to at checkout; later price changes do not affect an accepted order.

Available payment methods are displayed at checkout. Prepaid orders require successful payment authorization or receipt of payment as stated there. Cash on delivery applies only if offered for your order, with any fee disclosed before purchase. We issue the paper or electronic invoice or receipt required by law.

Payment providers may apply their own lawful processing terms. Their involvement does not remove our responsibilities as the seller. We will not ask you to disclose your payment password or one-time password to our staff.

6 Promotions and discount codes

Promotions may have stated eligibility requirements, expiry dates, limits, or exclusions. These conditions will be disclosed with the offer. Codes cannot be combined unless the offer permits it. We may refuse a code obtained or used fraudulently, but will not retrospectively remove a valid discount from an accepted order without a lawful basis.

7 Shipping and delivery

Delivery areas, fees, and estimated delivery periods are provided at checkout or in the delivery information shown before purchase. Estimates may be affected by location, weather, holidays, or courier disruptions. Any expressly agreed delivery deadline remains subject to the contract and applicable law.

We will communicate material delays and work with you on an appropriate solution. If delivery fails or the goods are lost or damaged in transit without your fault, contact us for assistance and the applicable remedy. Handing a parcel to our courier does not by itself remove our responsibility to you.

You must provide a deliverable address and reasonably cooperate with delivery arrangements. If redelivery is needed because of incorrect information or an unjustified missed delivery attributable to you, any reasonable additional charge must be explained and agreed before it is incurred. A failed delivery does not automatically forfeit the full purchase price. Inspect the parcel when reasonably possible and report concerns promptly; acknowledging delivery does not waive a hidden-defect claim.

 

8 Cancellation requests

Contact us as soon as possible if you wish to cancel or change an order. We will confirm whether the request can be accommodated and explain any lawful, previously disclosed charges before asking you to agree. An email requesting cancellation is not confirmation that cancellation has been completed.

For an order already dispatched or involving a third-party delivery service that has advanced payment, cancellation may be restricted under applicable law. We may agree on a return or another lawful arrangement. These restrictions do not remove remedies for defective goods, misdescription, non-delivery, or our breach of the contract. If we agree to cancel a prepaid order, we will refund the amount due, subject only to lawful and agreed deductions.

9 Returns and consumer remedies

You may seek the remedies available under Philippine law when a product is defective, damaged without your fault, expired when supplied, incorrect, materially misdescribed, or fails to meet an applicable warranty or contractual obligation. Depending on the circumstances, these include replacement, refund, repair where appropriate, or another remedy provided by law. The remedy will not be determined solely at our discretion.

For cosmetics, repair will generally be unsuitable. We will assess the concern fairly and provide the appropriate replacement, refund, or other lawful remedy. Sale items, promotional items, and products opened to discover a defect remain eligible for any remedy required by law. A hygiene restriction will not be used to reject a valid defect or safety claim.

We do not ordinarily accept returns solely because you changed your mind, chose the wrong shade yourself, or no longer want a correctly supplied, non-defective product, unless a specific offer provides otherwise. This does not apply where the issue arises from an inaccurate description, our recommendation forming part of the agreed sale, a defect, or another legal entitlement.

Available photographs, batch details, packaging, or other relevant evidence, if reasonably obtainable.

Please report concerns promptly and keep the product and packaging where reasonably possible. An unboxing video is helpful evidence, but it is not a mandatory condition for a valid claim. The absence of original packaging or a paper receipt will not automatically defeat a claim that can be established by other reasonable evidence. We do not impose a short reporting window that overrides applicable legal rights or claim periods.

Where replacement or refund requires return of the original goods, we will provide return or collection instructions and bear the necessary return costs for a valid claim covered by law. Please cooperate with reasonable inspection and return arrangements. If a product may be unsafe to transport, contact us before sending it. Retain it safely pending instructions unless safety or an authority requires otherwise.

10 Refund handling

Once a refund is due, we will process it without undue delay and within any period required by law, explaining the amount, method, and expected processing time. We ordinarily use the original payment method; if that is unavailable or payment was by cash on delivery, we will agree on an appropriate alternative with you. Store credit will not replace a refund you are legally entitled to unless you freely agree.

Refunds will include delivery charges and other amounts where required by law or the circumstances of the cancellation. We do not charge a restocking fee for a valid defect, wrong-item, or other claim arising from our failure. Bank or payment-provider posting times may vary; we will provide reasonable assistance if the credit is delayed.

11 Product use and safety concerns

Read the label, ingredients, instructions, storage directions, and warnings before use, and use the product only for its intended purpose. Our website provides product information and general skincare education, not individualized medical diagnosis or treatment. Cosmetics are not represented as medicines or guaranteed cures for skin conditions.

Individual experiences can vary. This does not disclaim an express claim, warranty, safety obligation, or remedy for a defective or misdescribed product. If irritation or an unexpected reaction occurs, stop using the product and seek appropriate medical advice. Please also contact us with the product and batch details so we can investigate. A reaction is assessed on its facts and is neither automatically proof of a defect nor automatically excluded from a valid claim.

If a safety notice or recall affects your purchase, follow the instructions we or the appropriate authority provide. We will cooperate with applicable safety and recall requirements. The business certificate number in these Terms is not a representation of FDA approval or product notification.

12 Website content and acceptable use

The website’s original text, designs, logos, photographs, and other protected materials belong to us or their respective rights holders. You may view the site and use information for lawful personal shopping and other uses permitted by law. Commercial copying or use of protected material requires the relevant rights holder’s permission unless a legal exception applies.

Do not impersonate another person, submit fraudulent orders or claims, introduce malicious software, attempt unauthorized access, or interfere with the website. We may reasonably restrict access to address unlawful activity, security threats, or a material breach. Any restriction will not erase your rights concerning a paid order, complaint, or refund.

13 Reviews and customer content

Reviews must reflect your honest experience and must not infringe another person’s rights or disclose private information without permission. You retain ownership of your submissions. By submitting a public review, you permit us to display and format it with the display name you choose on the website and related review service, without changing its meaning.

We may remove unlawful, fraudulent, abusive, or irrelevant submissions. A review will not be removed merely because it is critical. Reusing your identifiable photograph, testimonial, or review in separate advertising requires any additional permission or consent applicable to that use.

14 Privacy and third-party services

Our Privacy Policy explains how we process personal data and how you can exercise your rights under the Data Privacy Act of 2012. It is available on charisdor.com or by contacting us. Acceptance of these Terms is not consent to optional marketing or every form of personal-data processing.

Third-party websites and services may have separate terms. Please review them before use. We are not responsible for independent third-party content merely because we link to it, but this does not exclude responsibility for services we engage to fulfill our own obligations or liability otherwise imposed by law.

 

15 Responsibility and events beyond our control

We remain responsible for performing our obligations and for liability imposed by Philippine law. These Terms do not exclude statutory warranties, valid consumer remedies, liability for fraud, willful misconduct, gross negligence, unsafe or defective products, or any other liability that cannot lawfully be excluded. There is no blanket limitation of all claims to the purchase price.

We take reasonable steps to keep the website available and accurate, but temporary interruptions may occur. An interruption does not cancel our duties regarding accepted orders, customer data, or refunds. Any claim for loss will be assessed under applicable law, including the relevant rules on causation, proof, and mitigation.

Events outside reasonable control, such as severe natural disasters or government restrictions, may affect performance. We will notify affected customers and take reasonable steps to reduce the disruption. Any relief from liability applies only to the extent permitted by law. Such an event does not automatically allow us to keep payment for goods we cannot supply or remove a customer’s lawful cancellation or refund rights.

16 Complaints and dispute resolution

For a complaint, email charisdor.cosmetics@gmail.com with the subject line “Customer Complaint”, or contact 09602212735. Provide your contact information, order details or other proof of purchase, a description of the issue, and the resolution you are requesting. We will acknowledge the concern, investigate, and communicate our response and proposed resolution.

For disputes covered by the Internet Transactions Act of 2023, please first use our internal complaint process as required by that law. The process is deemed exhausted if the complaint remains unresolved after seven (7) calendar days from filing. This is an escalation rule, not a seven-day deadline for reporting a defect or a requirement that you accept our proposed remedy.

You may then pursue the remedies available through the Department of Trade and Industry, the appropriate government agency, or a competent court, subject to applicable procedures. Product safety or cosmetics regulatory concerns may fall within the Food and Drug Administration’s jurisdiction; privacy concerns may be raised with the National Privacy Commission. Nothing here prevents an urgent report or remedy where the law permits it.

Official information is available at https://www.dti.gov.ph, https://www.fda.gov.ph, and https://privacy.gov.ph. You are not required by these Terms to submit disputes to binding private arbitration or to waive access to a competent Philippine court or agency.

17 Governing law

These Terms and purchases through charisdor.com are governed by the laws of the Republic of the Philippines. These include, where applicable, the Civil Code, the Consumer Act of the Philippines (Republic Act No. 7394), the Electronic Commerce Act of 2000 (Republic Act No. 8792), the Internet Transactions Act of 2023 (Republic Act No. 11967) and its implementing rules, and relevant privacy and product safety laws.

Jurisdiction and venue are determined by applicable Philippine law and procedural rules. These Terms do not require every customer to bring a claim exclusively in Davao del Norte or in a foreign forum.

18 Changes and interpretation

We may revise these Terms for future transactions by posting an updated version and date. Material changes will be brought to your attention where required. The version accepted when your order was placed will govern that order, except where a change is required by law or you agree otherwise. We will not retrospectively reduce your rights through an update.

Any specific order terms or promotional promises we expressly agree with you form part of that transaction. If a provision is unlawful or unenforceable, the remaining provisions continue to apply to the extent legally possible. Failure to enforce a provision immediately is not a waiver of the right to enforce it later. Mandatory law prevails over inconsistent website terms or policies.
